The following terms and conditions are part of the agreement of work to be performed by Pine Edge Landscaping Inc. with the information contained herein, constitute the entire agreement. This proposal is valid for 1 year and is continuous unless otherwise noted.

PERFORMANCE BY PINE EDGE LANDSCAPING, INC.

Work crews will arrive at the job site unannounced unless otherwise noted herein. The schedules may vary due to weather, client schedules, or conflicts. The client will be contacted should any significant changes in the program be necessary. The work performed by our maintenance crews are performed on a weekly basis unless otherwise specified.

WORKMANSHIP

All work is performed in a professional manner by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly. The client is responsible for advising Pine Edge Landscaping Inc. regarding the location of underground utilities such as gas lines, water lines, electrical wires, and irrigation lines, in the area where work is to be done. Pine Edge Landscaping Inc. shall not be responsible for damage to such utilities, unless the location has been indicated prior to the commencement of work. The owner agrees to indemnify and hold harmless Pine Edge Landscaping, Inc. Contractor from and against any and all damage and/or liability arising out of any incident that occurs either before Pine Edge Landscaping Contractor performs its duties under the contract/proposal or after Pine Edge Landscaping Contractor has left the premises. Owner agrees to indemnify and save harmless Pine Edge Landscaping Contractor from any and all liability arising as a result of the owner’s own negligence. Any dispute, controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be determined and settled by a judge. The ruling shall be final and binding. Judgment on the award may be entered in any Court having competent jurisdiction thereof.

INSURANCE

Pine Edge Landscaping is insured for the liability resulting from injury to persons or negligent damage to property, and all its employees are covered by Workers’ Compensation Insurance. A certificate of insurance is available upon request.

OWNERSHIP

The client warrants that all trees, plant material and property on which work is to be performed are either owned by the signatory to this agreement or that permission for the work has been obtained from the owner by the signatory. It is further agreed that the property owner or representative shall be responsible for obtaining any and all permits which may be required by local authorities. Pine Edge Landscaping is hereby held harmless from all claims for damages resulting from the client’s failure to obtain such permits.

The property owner maintains the responsibility for monitoring & inspecting the premises. Pine Edge Landscaping is not responsible for the melting and/or re-freezing of snow, ice or rain after application of salt or melting agent(s) as directed by the owner. Services of Pine Edge Landscaping are deemed to be satisfactory unless property owner notifies Pine Edge Landscaping of a problem within 24 hours of the services performed. Pine Edge Landscaping is not responsible for injuries or losses that occur after Pine Edge Landscaping leaves the premises. Property owner agrees to indemnify and hold harmless Pine Edge Landscaping from any and all liability arising as a result of the owner’s own negligence.

TERMS OF PAYMENT

All accounts are payable upon receipt of invoice. A deposit of 50% may be required prior to the commencement of Landscape construction, and design work. All payments should be sent to Pine Edge Landscaping, P.O. Box 1499, East Quogue, NY 11942. A service charge of $30.00 will be charged for any returned check. Invoices which are not paid within 30 days of invoice date will be considered past due. Accounts past due are subject to a service charge of 2% per month. Your next service may not be performed if your account is past due. Past due balances void any guarantees. If outside assistance is used to collect the account, the client is responsible for all costs associated with the collection including, but not limited to reasonable attorney fees and court costs. (Sales tax will be added to the amounts of this estimate per your local and state tax jurisdiction.)

CANCELLATION OF CONTRACT

To cancel services, Pine Edge Landscaping must receive notification in writing with a certified mail receipt prior to services being completed.

CONCEALED CONTINGENCIES

Owner agrees to pay contractor on a time and materials basis for any additional work required to complete the job. If market prices rise due to any circumstance in purchasing materials, i.e., fuel, fertilizer, fungicide, weed control, seed, mulch, flowers, prices will be adjusted to cover additional expenses beyond our control.
